- These Terms and Conditions of Use are legally required by law. Everything listed on this website implies that you understand and agree to our Terms and Conditions. Your statutory rights are not affected and are of no interest.
- By accepting and/or purchasing any of the services from Pickled Roots Photographer you agree you have read and accepted all terms and conditions described on this website.
- You (client) agree that Pickled Roots Photographer has no liability, now and in the future, to be obliged and/or required to inform you of such responsibilities and/or information/s relating to this website, its content and/or its terms and conditions. You also (client) assume full responsibility for informing yourself personally.
- Pickled Roots Photographer has no liability and/or responsibility to make sure that you (the client) is aware of all terms and conditions and/or any other aspect related to any services, obligations and duties of this website.
- It is your absolute responsibility to read these Terms and Conditions of Use and any regulations of this website carefully before purchasing, using or accessing any product offered by Pickled Roots Photographer. Pickled Roots Photographer assume no liability now and in the future if you, (the client) has not read the following Terms and Conditions of Use.
- All products and/or services are owned and supplied by Pickle Roots Photographer ("Company" "Pickle Roots Photographer" or "we" or "us" or "our"). The term "you" or "your" "couple" or "customer(s)" refers to any user or purchaser of such products and/or services.
- PickledRoots Photographer reserves the full right to update and change these Terms and Conditions of Use and any regulations of this website at any time and to update them accordingly with the "date last updated" at the top of this page. Pickled Roots Photographer assumes no liability now and in the future, no responsibility or obligations to communicate such changes and updates directly and/or indirectly in any way.
- You are legally bound by these Terms and Conditions whether you have read them or not. If you do not agree with any of our Terms, please contact Pickled Roots Photographer by email only, any conditions will be evaluated without obligation of acceptance.
- By using Pickled Roots Photographer website, you agree to be 18 years of age or older and have the legal authority to enter into these Terms and to purchase any goods and/or services.
- To book one of our services you must be 18 years old or older.
- If you are under 18 years old, or you are requesting a photo shoot session for/or someone under 18 years of age please mention it on the contact form or contact Pickled Roots Photographer before booking, a consent form must be issued and signed by any parent/s or guardian/s.
- Pickled Roots Photographer is not responsible for any unsolicited information prior to the photo shoot.
- Picked Roots Photographer performs photo shoots/video and welcomes everyone without prejudices and/or distinctions of sex, ethnicity, sexual, religious or political orientation.
Pickled Roots Photographer operates stress free photo shoot sessions, respecting the wishes of the client whenever possible. Clients will never be pushed into uncomfortable situations and will always have control to decide the course of the session. Pickled Roots Photographer’s priority is to provide a pleasant and safe experience and satisfy the client/s through the presentation of the images/video captured.
-Through but not exclusively the "contact page", and/or the "booking page" you will be asked to accept these Terms & Conditions of Use and any regulation of this website and services. After your confirmation and accepting these agreements Pickle Roots Photographer will automatically obtain your full and absolute consent to be able to take photos and/or videos, use any images and/or videos for the client(s) and/or for each participant present during the session and/or event and/or any other paid services provided by Pickled Roots Photographer that has been requested.
- Client agrees that any photograph and/or video taken by Pickled Roots Photographer may be used for commercial purposes, display, portfolio, advertisement, website, social media, editorial publication, for educational purposes, on related industry forums, print and/or online publication, photography exhibition, competition applications, photography competition, to promote Pickled Roots Photographer company and/or any business related to, share with contributors and/or vendors if/or necessary with the intention of/for mutual advertising but not only who may have participated to the same event but not only restricted to and more.
- Client agrees that the videos and/or images taken and/or used by Pickled Roots Photographer may be used without any and/or additional compensation to the client and/or any participants which were attending the photo and/or video session under any of the circumstances listed above.
In case the client and/or partecipant/s does not agree, Pickled Roots Photographer should be notified upon written request via email only prior to the photo shoot/session. Requests will not be accepted once the photo shoot takes place or when the work from Pickled Roots Photographer has been completed.
The customer understands and accepts the following:
- The customer may not assign or transfer this Agreement or any rights granted hereunder. The contract is linked only to the name of the customer present in the requested booking.
- This agreement is binding on the customer and is to the benefit of Pickled Roots Photographer, as well as their respective principals, employees, agents, affiliates, heirs, legal representatives, successors and assigns. The customer and its principals, employees, agents and affiliates are jointly and severally responsible for the performance of all payments and other obligations hereunder.
-No amendment or waiver of any article is binding unless established in writing and signed by the parties.
- Email, electronic signatures and electronic consents will be considered legal and binding.
- However the invoice(s) may reflect, and the customer is bound by, the customer's oral permissions and requests for any additional Images, fees and expenses, which could not be confirmed in writing due to the immediate proximity of the completion of the assignment.
-Pickled Roots Photographer assumes no liability and/or any responsibility for non-fulfillment of any verbal client requests throughout the contract agreement process.
- This agreement will be deemed a contract made under Australian law for all purposes and circumstances, and will be construed in its entirety in accordance with such laws.
- The Client specifically and irrevocably grants personal jurisdiction over it by the courts of WA, Australia.
- client(s) agrees and accepts full liability to pay all costs of arbitration and court, reasonable attorneys' fees, attorneys' fees and interest, on any award or judgment in favor of Pickled Roots Photographer.
-All images and/or videos and digital files are protected by Australian and International Copyright Laws and remain now and in the future property of and only of PickledRoots Photographer.
- Any agreements stipulated with Pickled Roots Photographer and this website are subject to the laws of Western Australia and Australia. If there is a dispute between you (client) and Pickled Roots Photographer which results in litigation, you must submit to the jurisdiction of the Western Australian courts.
- In addition to oral and written agreements, the use of any image/viceo by the customer will constitute acceptance of all the above terms and conditions.
BOOKINGS RESCHEDULE, POSTPONEMENTS, CANCELLATIONS, AND REFUND
BOOKING
- Questions and doubts are absolutely normal, so don’t be afraid, hit me up!
Pickled Roots Photographer offer and recommends always a friendly meeting in person, phone call and/or video chat where doubts and/or details can be discussed, as well as answer any questions you may have, please use the contact form or book one of the suggested services to do so.
- Pickled Roots Photographer could, but is not bound, to offer alternative payment options to suit every budget. Please consider submitting a request before booking.The evaluation will remain at the discretion of Pickled Roots Photographer.
- Each reservation requires a deposit. By paying the deposit fee you agree not to assign any liability to Pickled Roots Photographer that you (the client) have read and accepted all our terms and conditions, any content, including our prices and ethical working arrangements provided on this website about our services.
- Accepting terms and conditions, contents, prices and work ethics agreements provided on this website about our services is mandatory in order to book any Pickled Roots photographer service. Alternative options will be considerate or will not be accepted in any way.
-You (the client) agree have not been pressured and/or forced in any way and/or felt intimidated and/or threatened to purchase any Pickled Roots Photographer’s service by Pickled Roots Photographer.
- This website and all its contents may/could be updated and/or modified and/or removed in all its aspects at any time by Pickled Root Photographer. You (the client) agree that Pickled Roots Photographer has no obligation and/or responsibility to notify and/or advise you (the client) now and in the future, and also you (the client) agree and understand it will be Pickled Root Photographer's discretion to do so.
- Future orders will be charged at the prices in place at the time of the order.
.- All services over AU$400, a AU$200 non-refundable deposit fee is required to secure your photo session reservation.
- All services under AU$200, a full price non-refundable deposit fee is required to secure your photo session reservation.
- The reservation is guaranteed only through the deposit fee payment through the appropriate website page or by direct bank transfer (please specify your details and/or invoice number)
- Deposits are not transferable to another person under any circumstances.
- Deposits are non refundable under any circumstances.
- The balance payment invoice will be sent to the client the day following the appointment to be paid before the expiry date or fee will be applied.
- Booking deposit are valid for 1 year from the date of purchase and will be subject to the Terms and Conditions in place at the time of booking. After 1 year the deposit will be retained and a new deposit will be required.
- Pickled Roots Photographer assumes no responsibility for any loss of deposit over their expiration date.
- Booking through the appropriate website page is preferable. Summaries, reminders, and notifications will be automatic, however:
- Different fees apply for each booking service(s) arranged by Pickled Roots Photographer under request of client’s authorization via email, social media messages and/or text messages without using the appropriate website.
- For all services over AU$400, a 50% non-refundable deposit fee is required to secure your photo session reservation.
- For all services under AU$200, a 100% non-refundable deposit fee is required to secure your photo session reservation.
- The reservation is guaranteed only through the deposit fee payment by direct bank transfer (please specify your details and/or invoice number).
- You (client) agree and accept all terms & conditions on this website.
- You (the client) agree that Pickled Roots Photographer has no obligation and/or responsibility to notify and/or advise you (the client) now and in the future about all terms & conditions on this website, and also you (the client) agree and understand it will be Pickled Root Photographer's discretion to do so.
- You (the client) accept full responsibility to find out about the terms & conditions of this website and also you (the client) agree that Pickled Roots Photographer has no obligation and/or responsibility to notify you (client) about that.
-In case of a mistake paying the wrong service the deposit will not be refundable but transferable to the desired service through written communication via email only (not via social media, text message or phone call) within 24 hours (every day of the year).
- In case of overpayment the deposit will not be refundable but transferable to the desired service through written communication via email only (not via social media, text message or phone call) within 24 hours (every day of the year). Pickled Roots Photographer will refund the difference(s), using the bank details provided in the email by the customer within 48 hours of receiving the email or as soon as possible.
- Once the Client and the Photographer have agreed on a time and/or date and for an assignment. Pickled Roots photographer agree not to accept further work at the same time necessary for the execution of the service.
-The presence of friends, relatives, children and animals during the sessions is not recommended if they are not part of the session for which Pickled Roots Photography has been hired for. Please ask in advance.
- Any conversation via email, social media, text message related to the service will be kept as a record and valid demonstration of the agreements until the end of the contract agreement (receipt and permission to download the images/videos). Any telephone calls and/or verbal conversations will not be considered valid to the terms of delivery of the work. The client(s) agree that Pickled Roots Photographer have no liability about it.
- Pickled Roots Photographer will not be responsible for any other damages to anything and/or anyone beyond the amount of this agreement.
PHOTO SHOOT RESCHEDULE, POSTPONEMENT
Notice more than 7 days before the appointment
- For each booking one reschedule only will be allowed.
- Reschedules and postponements with more than 7 days notice prior to the date of the booking need to be notified (any day of the year) by email only (not via social media, text message or phone call).
- Reschedule fee of AU75$ will be applied for any service.
- Client(s) must reschedule within 3 weeks (if availability and/or time permits and to the discretion of Pickled Roots Photographer) from the original booking date.
- In case of cancellation for any reason of the reschedule, full costs and expenses will be charged and a new booking process will be required.
Notice with or less of 7 days to 3 days before the appointment
- For each booking one reschedule only will be allowed.
- Reschedules and postponements between 7 to 3 days notice prior to the date of the booking need to be notified (any day of the year) by email only (not via social media, text message or phone call).
- Reschedule fee of AU100$ will be applied for any service.
- Client(s) must reschedule within 3 weeks (if availability and/or time permits and to the discretion of Pickled Roots Photographer) from the original booking date.
- In case of cancellation for any reason of the reschedule, full costs and expenses will be charged and a new booking process will be required.
Notice with or less than 72 hour before the appointment
- For each booking one reschedule only will be allowed.
- Reschedules and postponements with or less than 72 hour notice prior to the date of the booking need to be notified (any day of the year) by email only (not via social media, text message or phone call).
- Reschedule fee of AU150$ will be applied for any service.
- Client(s) must reschedule within 3 weeks (if availability and/or time permits and to the discretion of Pickled Roots Photographer) from the original booking date.
- In case of cancellation for any reason of the reschedule, full costs and expenses will be charged and a new booking process will be required.
Notice 24 hour or less before the appointment
- For each booking one reschedule only will be allowed.
- Reschedules and postponements with or less than 24 hour notice prior to the schedule of the booking need to be notified asap by email only (not via social media, text message or phone call).
- Reschedule fee of AU250$ will be applied for any service.
- Additional 100% travel fee and expenses will be charged for any service.
- Client(s) must reschedule within 3 weeks (if availability and/or time permits and to the discretion of Pickled Roots Photographer) from the original booking date.
Please note:
Penalties apply for any reschedules and postponements regardless of the reasons and/or cause, including, in particular, but not limited to Covid 19 circumstances, weather conditions, majeure forces and/or fault of third parties.
CANCELLATION
- Client has the right to cancel and/or terminate the appointment at any time, client is aware fees will be applied.
- Cancellation at any point will forfeit your deposit.
- Cancellation within 1 week of the booking appointment forfeit 50% of the booking fee, expenses and full travel fee.
- Cancellation within 72 hours of the booking appointment, forfeit the entire amount of the booking, expenses and full travel fee.
- Considerations are at the discretion of Pickled Roots Photographer on a case by case basis.
RESCHEDULE, POSTPONEMENT, CANCELLATION FROM FAILURE TO PERFORM OF PICKLED ROOTS PHOTOGRAPHER
Photo shoot
Client(s) agree and understand:
- If at any time prior the appointment with the client(s) and in any situation Pickled Roots Photographer is unable to perform its services (need to reschedule, postponement, cancellation) and the contract agreement due to circumstances such as illness, mechanical breakdown, accident, personal and/or family reasons and/or any other cause beyond its control, no deposit will be returned and/or refunded under no circumstances for any services, except Weddings (for weddings click here).
- Pickled Roots Photographer will attempt but is under no obligation to supply any type of substitute, if any, in full compliance with the contract entered into with the customer.
-Pickled Roots Photographer agree and is committed to refund the client(s) with the balance amount of the session and all expenses paid and agrees to arrange a new date within the next 3 weeks (if available and/or time allowed and/or to discretion of PickledRootsPhotographer).
- It will be Pickled Roots Photographer’s discretion to consider every aspect involved like weather conditions, location and more.
One time event(s)
- If at any time prior the appointment with the client(s) and in any situation Pickled Roots Photographer is unable to perform its services (need to cancel) and the contract agreement due to circumstances such as illness, mechanical breakdown, accident, personal and/or family reasons and/or any other cause beyond its control, Pickled Roots Photographer will attempt but is under no obligation to supply any type of substitute, if any, in full compliance with the contract entered into with the customer.
- If Pickled Roots Photographer have no possibilities to respect any part of the contract agreement and is committed to refund the client(s) with any amount paid in full, but shall have no further liability in respect to the contract.
- Client(s) agree and accept no more actions against Pickled Roots photographer and client(s) will consider the end of contract once fully refund.
- Client(s), agree and accept to not persecute in any way and/or legally persecute Pickled Roots photographer once fully reimbursed.
Wedding
- If at any time prior the appointment with the client(s) and in any situation Pickled Roots Photographer is unable to perform its services (need to cancel) and the contract agreement due to circumstances such as illness, mechanical breakdown, accident, personal and/or family reasons and/or any other cause beyond its control, Pickled Roots Photographer will attempt but is under no obligation to supply any type of substitute, if any, in full compliance with the contract entered into with the customer.
- If Pickled Roots Photographer have no possibilities to respect any part of the contract agreement and is committed to refund the client(s) with any amount paid in full, but shall have no further liability in respect to the contract.
- Client(s) agree and accept no more actions against Pickled Roots photographer and client(s) will consider the end of contract once fully refund.
- Client(s), agree and accept to not persecute in any way and/or legally persecute Pickled Roots photographer once fully reimbursed.
PAYMENT
- Pickled Roots Photographer is committed and performs the assignment with/for the client(s) in the best professional way.
- The client understands and agrees to pay Pickled Roots Photographer all costs and expenses in connection with the assignment delivered, whether or not the client uses the images/videos.
- The balance payment invoice will be sent to the client the day following the appointment to be paid before the expiry date or fee will be applied.
- Client understands and agrees to always pay by due date, in any circumstances, any invoices related to the assignment requested by you (client) to Pickled Roots Photographer or fees will apply (AU$50/each day late)
-Client will be able to purchase more images at the following rates:
1-10 images: AU$40 ea
11-30 images: AU$ 18 ea
31-50 images: AU$15 ea
50-100 images: AU$ 11 ea
100 > images: AU$8 ea
- A new invoice will be issued if the customer decides to purchase more images and only after the full payment the download will be possible.
- After Pickled Roots Photographer delivers the assignment (photos and/or videos), the client understands and agrees that fees will apply to/for additional work and/or any additional time (AU$180/hour) (e.g. client failure, refusal to accept images/video as delivered, request for modifications of any nature).
- Any use of images/videos before full payment will be considered an unauthorized use. No rights granted unless.
- The client agrees that the reasonable amount to be paid to Pickled Roots Photographer for any unauthorized use of image(s)/video(s) prior full payment and/or permission will be triple the invoice total.
- Notifications adjustments of amounts or terms of the invoice(s) must be requested by email only by the expiry date on the receipt of the invoice.
- The photographer's invoice will serve as the Client's receipt for work performed and services rendered.
GENERAL CODE OF CONDUCT AT THE TIME OF THE SHOOTING/OR VIDEO:
- Pickled Roots Photogrpher operates at any time a zero tolerance policy for harassment, bullying, disrespectful or inappropriate behavior prior and/or during any session.
This includes, but not limited to:
Stalking, Intimidation, Offensive verbal comments, Physical assault and/or battery, Harassing or non-consensual photography or recording, Inappropriate physical contact, Unwelcome physical attention.
In relation to, but not limited to: Race,Color, National origin, Sex ,Gender ,Gender identity, Gender presentation, Sexual orientation ,Age ,Body size, Disability, Appearance, ReligionOur -Policy applies to everyone at the convention.
-If Pickled Roots Photographer receives such conduct from you (the client/s and any participants) or feels compelled by such uncomfortable conduct , Pickled Roots Photographer will result in immediate suspension and termination of the stipulated contract without refund and full payment of all the costs from the client to Pickled Roots Photographer.
- If for any reason the client requests a new shoot at the time of the session (incomplete session/cancellation/postponed session/reschedule session/failure to perform session of any kind ), the client agrees to pay Pickled Roots Photographer a fee equal to 100% of the fee shown on the invoice for the original shoot and related expenses, plus all charges for the new photo shoot (if requested by the client/s) followed by the same terms & conditions (1 reschedule only available) of this website.
- If for any reason a new session is required for reasons beyond Pickled Roots Photographer's control, including, but not limited to, weather conditions, acts of God and/or third party fault, Pickled Roots Photographer assumes no liability and will not charge an additional fee, but the customer assumes full responsibility and agrees to pay all expenses for the session and service. Both Pickled Roots Photographer and the client must agree to this condition.
The Client(s), acknowledge, understand and accept all of the above and consent to his/her release as provided above:
- The Client releases and agrees to indemnify and hold harmless Pickled Roots Photographer from any and all liabilities arising from the shoot involvement or participation in the shoot services, even if arising from the negligence of Pickled Roots Photographer.
- I acknowledge that the photo sessions may be undertaken with one or more other persons as part of a group and that Pickled Roots Photographer is not liable for the actions of other participants.
- By accepting below, I acknowledge, agree and understand that the risks associated with the Pickled Roots Photographer Services have been explained to me. I undertake any such risk voluntarily and at my own risk.
- I agree that if I suffer any injury, Pickled Roots Photographer may not be able to provide first aid and/or medical treatment.
-I agree to and unconditionally release, waive, discharge and forever hold harmless, Pickled Roots Photographer or any of its employees, agents, directors or officers, from any claims as a result of any personal injury sustained, whether caused by Pickled Roots Photographer's negligent act or omission, breach of contract, breach of statutory duty, error, or otherwise in connection with or arising out of the photo shoot activities.
TOTAL OR PARTIAL LOSS OF FILES MATERIAL
- Pickled Roots Photographer assumes no liability for any accidental loss and/or not intentional destruction of any original or modified files of the session and/or event during the post-processing caused by human error and/or by a failure of the computer, software and/or electronic equipment used. In such circumstances we will return to you (the client) any amount paid in full, but shall we have no further liability in respect to the contract.
IMAGE/VIDEO PROCESSING
- PickledRoots Photographer will professionally perform color correction and retouching prior to delivering any physical copies of images to the clients.
- Images/videos are professionally edited and color matched to the highest standard. Basic retouching of minor blemishes, marks and/or distracting background elements are included in all packages. Major retouching e.g.. head swapping, merging of images is NOT included and will be quoted and/or charged as requested at a rate of $250/hr (plus GST).
- PickledRoots Photographer will personally select the best images from the session/event on behalf of the client. It will remain the discretion of PickledRoots Photographer to allow client(s) to select their own images/video from the gallery delivered.
- Under no circumstances will RAW or unedited files be supplied.
DIGITAL FILES STORAGE
- The client understands and accepts the full responsibility to store and archive all the images properly from the day of delivery by Pickled Roots Photographer, through a specific download and/or folder/s.
- Pickled Roots Photographer does not guarantee and assume no liability for the availability of any images/videos beyond the notified delivery date (1 month) from the delivery day to the client.
- Client understands and accepts full responsibility and advice to create and save multiple copies of files received from Pickled Roots Photographer.
Pickled Roots Photographer advise but/and the clients must be aware that optical, magnetic, electronic and any other software for digital data storage can be unstable and unpredictable.
- Pickled Roots Photographer assume no liability and shall not hold its software systems harmless from any liability for any claims, damages or costs resulting from the unusability of any media provided to the client(s).
- Client understands and accepts fees will be applied (AU$50) if copies of the files from the Photographer's archives will be requested after the expiring date.
- Pickled Roots Photographer assumes no liability for no archive files after the client expiring date.
- Pickled Roots Photographer does not guarantee and assume no responsibility for keeping copies of files beyond their expiration date.
DIGITAL FILE QUALITY
- Pickled Roots Photographer is committed to provide the highest quality JPEG files available respecting the standards of use of the client.
- Alternative file formats will be available upon specific written request by email only.
Client(s) agree and understand that such formats may be subject to fees as they contain complex information. Pickled Roots Photographer discretion.
- The files will always be provided in compliance with the regulations. In case the files are too large, Pickled Roots Photographer will use alternative methods.
Pickled Roots Photographer assumes no responsibility for the download of files by the client(s) through use of such third party software and/or possible issues related of any kind.
- Pickled Roots Photographer will be solely responsible for ensuring that the digital file is suitable and of high quality.
- Pickled Roots Photographer assume no liability for all necessary measures to ensure correct reproduction.
- Pickled Roots Photographer assumes no liability for poor quality reproduction of any files, delay, loss, expense, or consequential damages, directly or indirectly from defects and/or errors of third parties processing.
USE, CREDIT AND COPYRIGHT OF IMAGES
- Credits are always appreciated by the client but not mandatory if images/video are paid for in full.
- All images/videos on this website are protected and copyright by Pickled Roots Photographer. Copying, reproduction and any other form of reproduction of any document and/or image and/or video is prohibited without the prior written permission by and only by Pickled Roots Photographer.
- All information on this website has been created by Pickled Roots Photographer.
- The full or partial use without prior written consent by Pickled Roots Photographer of any content on the Pickled Roots Photographer website and all his platforms will be considered a flagrant violation of federal law and subject to the laws of Western Australia and/or Australia.
- If you intend to use or purchase content, images and/or videos for personal, commercial and/or other uses, please contact Pickled Roots Photographer by email only.
- All content in this website is property and owned by Pickled Roots Photographer.
- All images and videos, original and processed, remain the exclusive property of Pickled Roots Photographer. It's illegal to copy or reproduce any photograph and/or video, either physically or digitally, without prior written permission by and only by Pickled Roots Photographer.
Please remember all images, both physical and digital when purchased and/or provided to the client(s), are for personal use only.
No commercial use by the client(s) is permitted under any of our terms & conditions, including but not limited to resale, promotion of personal business, or use in contests or exhibitions as mentioned multiple times in this website. Please contact me about it. Permission must be released by and only by Pickled Roots Photogrpher.
- The Client acknowledges that Pickled Roots Photographer is the only author of the images/videos and also the first and only owner of all copyrights.
- All images and copyrights remain the exclusive property of Pickled Roots Photographer without limitation.
- Customers understand and agree that they are not purchasing the image, but instead paying only for a personal use license of the Image. The terms & conditions of the license begins on the date Pickled Roots Photographer receives the deposit payment and/or full payment of the invoice and/or the clients the chance to download the images.
- Metadata, raw files and all encrypted image data are copyright contained in any digital file and may not be modified or removed without the express consent of Pickled Roots Photographer. - Act accordingly by reproducing, approving the merits or ownership, providing and/or selling to third parties requires a prior written permission by and only by Pickled Roots Photographer.
- Don't use images/video without permission and copyright, please get in contact by email only if you intend to do so, prior written permission by and only by Pickled Roots Photographer.
- Any reproduction and/or copying of any material from this website and/or any Pickle Roots Photographer platforms that claims credit and/or title other than Pickle Roots Photographer, furnishes and/or sells to a third party without prior permission by and only by Pickled Roots Photographer will be considered a flagrant violation of federal law and may be subject to the laws of the Western Australia and/or Australia.
- If you wish to use and/or link to any of the content on this website and/or related social media owned by Pickle Roots Photographer, please contact Pickle Roots Photographer by email only to/or receive permission of use if authorized by and only by Pickle Roots Photographer.
- Placement of a credit line and/or copyright notice is required as specified in the Agreement by written Pickled Roots Photographer permission. Unauthorized use of any material such as image and/or video, and/or content, created and/or owned by Pickled Roots photographer will be not tolerated.
If such copyright credits and mentions are requested but not actually provided by the client(s), the customer agrees to indemnify such pre-agreed copyright damages in the amount of AU$500 per post, and/or image and/or video for each day up to the date of copyright credits modifications, paid to Pickled Roots Photographer for loss of acknowledgment or lack of copyright protection, arising out of lack or improper copyright notice or line of credit.
- Client(s) and/or fully refunded client(s) understands the following of the the gravity and guarantees they will never make public and/or make visible in any way and/or any circumstances in any way images/videos, such as sending screenshots to third parties, reviews on any website of any kind, social media, forums and more, photographs and/or videos without having paid in full for the service of Pickled Roots Photographer and therefore without having obtained the rights for using images and/or video for exclusive personal use. It will be considered a flagrant violation of federal law and may be subject to the laws of the Western Australia and/or Australia.
- The customer will bear the costs of indemnity, legal fees and any other compensation expense towards the damages of Pickled Roots Photographer reputation in the event that client(s) does not comply with any term & condition, trademarks, models and releases expressed on this site.
- If the customer fraudulently fails to comply with the terms & conditions of any agreement on this site, the client(s) agree to pay compensation equal to AU$2000, and possible legal action from Pickled Roots Photographer..
Any request must be requested in writing by email only and it will be considered and evaluated by and only by Pickled Roots Photographer.
CONSENT TO USE AND RIGHT OF PHOTOGRAPHS
- Credit is always appreciated by the client but not mandatory if images/video are paid for in full.
- Client agrees that any photograph and/or video taken by Pickled Roots Photographer may be used for commercial purposes, display, portfolio, advertisement, website, social media, editorial publication, for educational purposes, on related industry forums, print and/or online publication, photography exhibition, competition applications, photography competition, to promote Pickled Roots Photographer company and/or any business related to, share with contributors and/or vendors if/or necessary with the intention of/for mutual advertising but not only who may have participated to the same event but not only restricted to and more.
- The client agrees that the videos and/or images taken by Pickled Roots Photographer may be used without any additional compensation. In the event that the client disagrees, PickledRoots Photographer must be advised on written request (email only) prior to shooting, no requests will be accepted once the shot has been taken at the work done.
All respect and understanding will be given to the Customer's express request for non-consent.
- Any vendors or services who have not paid for the photography service and images must credit Pickled Roots Photographer except prior written authorisation from PickledRoots or legal action may be taken.
Forbidden to use for advertising campaigns, any kind of social media, blogs or magazine except prior written authorisation from PickledRoots or legal action may be taken. Contact Pickled Roots Photographer in advance for a purchase request.
For any other request to use the material please contact PickledRoots, we'll be happy to evaluate any type of request.
For all the unpaid services, collaborations, TFP services, permissions and authorizations for using photo/video by PickledRoots on any websites and social media must included the following procedures:
- Cropping the image 1: 1 will be possible if necessary, however, no filters must be added but remain as such products provided by PickledRoots.
- It is forbidden to enlarge the images, the resolution may show distortions or bad pixel quality.
If so please contact PickledRoots for better image quality.
- Copyright connected to the related hyperlink appropriate to Pickled Roots Photographer social media or website must be visible in the image/video and description/captions at all times
- Please make sure to use the right name and tag visible at all times.

UNAUTHORIZED REPRODUCTION
Client agrees not to reproduce or modify the images/videos provided by PickledRoots Photographer without first obtaining a formal written release signed by and only by PickledRoots Photographer. Should PickledRoots Photographer discover any violations to this agreement, the clients agree to be held financially responsible at a rate of AU$500 per single violation.
GIFT CARD
- Terms & conditions and booking terms & conditions apply to any gift card.
- If a recipient of the gift card wishes to purchase additional products, in addition to the value of the gift certificate, these will be charged according to our prices. Product orders must be placed by email request only and will be subjected to terms & conditions.
- The photo/video session will be held at an agreed time and place.
- Gift cards are valid within 40 km or 1 hour drive from Pickled Roots photographer’s office to location, otherwise non-refundable travel fees apply based on destination.
- Gift cards are non-refundable
- Gift cards cannot be redeemed for cash.
- Gift cards are valid for one photo session only.
- Gift cards are reserved exclusively for the recipient and are not transferable to third parties.
- Gift cards are valid for 1 year from the date of purchase and will be subject to the Terms and Conditions in place at the time of booking upon payment of the deposit or additional payment if required. - Pickled Roots Photographer assumes no responsibility for gift cards over their expiration date.

GOODS
- It is the Client's sole responsibility to request any desired prints, products, or files within 7 days of delivery date time, please get in touch if over date, it’ll be discretion of Pickled Roots Photographer to consider.
- Any goods order may be delivered by Australia Post and/or other reputable courier companies.
- Deliveries will be promptly processed upon and only after receipt of full payment.
- Delivery and delivery time may vary depending on the courier company or third party print lab involved and their delivery options.
- Pickled Roots Photographer will not accept liability for damaged and/or lost and/or not received orders. It'll be the full client's responsibility to solve the dispute with the courier company/print lab in charge of the delivery. It'll be to the discretion of Pickled Roots Photographer to be part of the dispute process without any obligations.
- It'll be discretion of Pickled Roots Photographer to consider replacement of damaged and/or lost items with no obligations.
- From confirmation of any print orders already paid in full from the client(s), Pickled Roots Photographer will not accept changes and/or refunds of any kind in any circumstances.
Cancellation will not be refunded.
- All print payments and artwork are non-refundable in any circumstances.
- Should you decide to return your order, Pickled Roots Photographer will consider it prior email notification only within 3 days from delivery to your address, or collected from lab (weekend, public holiday will be considered as a day to submit the request) explaining a valid reason for return it with clear and visible proved images attached of the item/s. Email with blurry images will not be considered.
- If necessary to send any print order back to the Pickled Roots Photographer or delegated original sender, costs will be at the customer's expense. The case will be evaluated and considered for a time up to 28 business working days. Pickled Roots Photographer will not assume liability for damaged orders back to the original sender, Pickled Roots Photographer or delegated labs.
- Pickled Roots Photographer will not assume liability for lost and/or not received orders.
- Pickled Roots Photographer advise the client to be provided and/or pay for parcel tracking number.
- Pickled Roots Photographe assume no liability for the quality of prints directly reproduced and/or printed and/or elaborated by the client from digital files after being purchased from or supplied by Pickled Roots Photographe.
- After the allowed time to return, to notify and/or receive orders PickledRoots Photographer will no longer have any obligations or liability towards the customer. Please contact Pickled Roots for any request over the expiring date.
- Open products will not be refunded and/or considered, however please contact Pickled Roots Photographer.
- Pickled Roots Photographer is committed to assist the clients to the best of the possibilities.
-Please consider all refunds are made at the discretion of Pickled Roots Photographer.
-Refunds will be processed promptly and payment made by the same method that you made payment in a maximum time up to 28 working days (Public Holidays and weekend not included).
PRINT QUALITY
- Pickled Roots Photographer is committed to the client and relay to reputable, certified and high quality print labs around Australia.
- Pickled Roots Photographer assume no liability of any kind under any circumstances from image/video produced by a third party company..
- The client understands and accepts prints may be affected from deterioration, change of tones, fading and/or discolor over time. Pickled Roots Photographer assume no liability from any responsibilities regarding the above circumstances.
- The Client agrees and releases Pickled Roots Photographer and his assigns, contractors and representatives from any liability for any claims, damages or costs arising from any above circumstances of any photo print or video elaboration.
- It'll be the full client's responsibility to solve any dispute with the print lab and/or company in charge. It'll be to the discretion of Pickled Roots Photographer to be part of the dispute process without any obligations.
COVID TERMS & CONDITIONS
- Client(s) must notify by email only In the event the session needs to be postponed due to covid or covid related lockdown or community restrictions in place, or you need to self-isolate, all booking terms and conditions regarding cancellation and non-refundable deposit will still be applied.
- It's the client's responsibility to check his health conditions prior to the booking date.
- Client(s) must provide Covid negative certificate for safety reasons.
- Reschedule date must be within 2 weeks of coming out of isolation.
- Pickled Roots Photographer agrees to reschedule within 2 weeks if any availability . Client(s) agrees it’ll remain Pickled Roots Photographer’s discretion to extend such a period.
